The plaintiff claim that the act violated section 2a because the act forced all peoples of Canada to participate in a Christian tradition when the charter states that all Canadians have the freedom of religion. Not only that the Lord’s Day Act was stated to have no valid purpose other than to protect the sanctity of the Christian Sunday sabbath.
