The human rights act
Definition: A set of rights which every human has to protect them such as the right to life, liberty and security.
How this relates to challenging behaviour: the human rights act relates to challenging behaviour because if the challenging behaviour is verbal abuse such as swearing then they may use the human rights act as an excuse for the behaviour they're doing such as using the right to speak.
The convention on the rights of the child
Definition: a specific set of rights for children which focus on civil, social, political, health and cultural rights for the child.
Why does this relate to challenging behaviour: this relates to challenging behaviour because if a child has a behaviour which effects other people such as their parents, then this act is there to protect them. If they need to be taken to a specialist care home then it has to be in the best interest of the child otherwise it breaks this act.
The childrens act
Definition: This is an act which is in place to protect all children and it includes to amend the law with respect to children's home, community homes and voluntary homes and organisations.
How this relates to challenging behaviour: this applies to challenging behaviour due to how much more vulnerable children with challenging behaviour are than other children and this protects them if anything happens.
The care standards act
Definition: this controls the concept of care and regulates who provides cafe in settings.
How this relates to challenging behaviour: this applies to challenging behaviour because it ensures that people with challenging behaviour is provided professional, good quality care.
White paper: valuing people
Definition: This act sets out a programme of action for improving services for people with challenging behaviours.
How this relates to challenging behaviour: This relates to people with challenging behaviour because it protects them from being abused and ensures that they're treated equally with the same rights as everyone else to protect them and stop discrimination.
Every child matters
Definition: This is an act which protects children and young adults by changing the approach to their well being.
How this relates to challenging behaviour: this relates to challenging behaviour because in the past, children with challenging behaviour haven't been treated the same as other children. This act prevents that from happening because it changes how services approach them and means that the services has the child's well being and best interests in mind.
Mental health act
Definition: This is the law which says when a person can be admitted, detained or treated in a hospital due to mental health issues against their wishes.
How this relates to challenging behaviour: this relates to challenging behaviour because the people who have challenging behaviour are vulnerable people so this protects them by giving them a voice. If they become admitted, it ensures a high standard of care is always carried out and there is a massively reduced risk of abuse.
HCPC: Health and care professions council
Definition: The health and social care professions council are the registration body for healthcare professionals.
How this relates to challenging behaviour: This relates to challenging behaviour because every healthcare professional has to register with the HCPC and have training in safeguarding and dealing with challenging behaviour.
NHS Constitution
Definition: a document which documents the rights and responsibilities of staff, patients and trust boards.
How this relates to challenging behaviour: this relates to challenging behaviour because it states the rights of the service user and the responsibilities of the staff member so everyone can implement such things as it is the law.
Ofsted
Definition: a "office for standards in education" who inspect and regulate educational services.
How this relates to challenging behaviour: this relates to challenging behaviour because it protects children with challenging behaviour by making sure where they're educated is up to the standard it needs to be such as adequate facilities for their needs.
Organisational policies and procedures concerned with behavioural management such as staff development and training, human rights and work practices
How this relates to challenging behaviour: this relates to challenging behaviour because this ensures that the staff are adequately trained and there are policies in place to ensure that the service user is treated correctly and that the staff are trained to be able to deliver safe and professional care.
