Representations
A representation is a statement of fact true to the best of ones knowledge, not absolute fact answers made by the insured in the application for insurance are considered to be representations.
Warranty
is a statement of fact that a condition does exist today and will continue to exist into the future.
Private Dwelling Warranty
this is a warranty that the described building is occupied exclusively for dwelling purposes only by not more than 4 families. Incidental business operations do not restrict the use of a private dwelling form.
Apartment Dwelling Warranty
this is a warranty that the described building is occupied exclusively for dwelling purposes only by more than 4 families.
The Dwelling Property Program
– (DP) this program is designed to cover the 1-4 family private dwelling. (Note: it would also cover a 1 family private dwelling with up to 5 roomers of boarders). {DP insurance is normally purchased by the Landlord} Dwelling property program - there are 3 forms available: 1. DP1 – Basic form 2. DP2 – Broad form 3. DP3 – Special form
Coverage A – Dwelling
this insures the residential building any structures attached to it as well as materials and supplies located at or next to which is used for construction, alteration or repair of any structure at the location.
2. Coverage B – Other Structures
This covers other structures at the described location that are not attached to the main dwelling and are at least separated by a clear space. Coverage is in the amount of 10% of Coverage A
Coverage C – Personal Property
this is optional coverage if purchased it covers personal property owned or used by the insured. The amount of coverage purchased is an on premises limit but the policy would provide for worldwide limit of 10% of Coverage C
4. Coverage D – Fair Rental Value
This provides compensation to the insured if the premises are unusable as a result of a covered loss or if use of the premises is restricted by the actions of a civil authority coverage is limited to 20% of Coverage A. (indirect loss) If a loss of use is caused by the actions of a civil authority then this coverage is limited to 2
5. Coverage E – Additional Living Expense
– this is optional coverage and is only available on a DP2 and DP3. This provides compensation to the insured for the increased living expense when they are forced to live elsewhere under the same provisions as Coverage D - Fair Rental Value.
DP1 – Basic Form
this inures the dwelling and other structures for the perils of fire, lightning and internal explosion
Extended Coverage Endorsement aka E.C. Perlis are W.C.S.H.A.V.E.R
Windstorm Civil Commotion Smoke – This broadens smoke coverage to include friendly fires excluding fireplaces industrial operations and agricultural smudging Hail Aircraft – Include objects falling from a plane and also includes spacecraft Vehicle – Excludes vehicles owned or operated by the insured or tenant Volcanic Eruptions Explosions – This excludes steam boiler explosions Riots – 3 or more people.
Vandalism and Malicious Mischief - (VMM)
this endorsement specifically excludes glass breakage
DP2 – Broad Form
this insures the dwelling and other structures for the same perils as a DP1 and automatically includes EC Perils, VMM and the Broad Form Perl’s B.I.G A.F.F.E.C.T Burglary Damage Ice sleet and Snow Glass Accidental Discharge – this covers the accidental discharge or over flow from within pluming and heating systems Falling Objects Freezing pipes Electrical - Covers damages to the electrical appliances caused by artificially generated electricity except for tube or transistors. Collapse – This means the sudden and the abrupt falling down caused by any of the following 1. A peril in the policy 2. Weight of rain on roof 3. Weight of contents, equipment, animals and people 4. Defective building materials or methods of construction 5. Hidden Decay 6. Hidden insects and Vermin Tearing Asunder (apart) steam boiler explosions Under a Broad form (DP2) policy or better the following coverage’s are included: 1. Smoke – includes fire places 2. Vehicles – Includes vehicles owns or operated by insured or tenant but except for losses to fences, driveways and walks
DP3 – The Special Form
This inures the dwelling and other structures on an all risk basis (Note: If personal property Coverage C has been included that coverage is only on a Broad Form Basis DP2)
All Risk Coverage
means coverage against loss caused by any accidental external circumstance subject to specific exclusions Note: the term “All Risk” has been replaced by either of the following: 1. Risk of Direct Physical Loss 2. Open Peril
Additional Coverage’s in a Dwelling Program
(Note: these are included at no additional Charge)
Debris Removal
this states that the company will pay the cost of cleaning up the property after a loss subject to a policy limit these expenses are included within the limit of coverage
Reasonable Repairs
this covers the reasonable expenses incurred by the insured at the time of loss to protect the covered property from further damage.
Preservation of Property
under the DP-1 coverage for 5 days after the removal under the DP-2 and DP-3 coverage for 30 days after removal
Trees, shrubs, plants and lawns
under DP-1 no coverage. Under DP-2-3 coverage is provided on a named peril basis but would not cover loss caused by wind, hail, wright of ice, sleet and snow and vehicles f the insured or tenant. Coverage is limited to 5% of the dwelling amount in total but nor more than $500 per tree, plant or shrub.
Fire Department Service Charge
this charge is limited to $500
Ordinance or Law Coverage
this is on a DP-2-3 only this covers the increased cost of repair construction or demolition regulated by any ordinance or law an additional 10% of the insurance amount is available for those expenses
Loss Settlement
Under DP1 recovery is on an ACV basis only. Under DP-2-3 buildings under Coverage A & B are at replacement cost without deduction for depreciation provided the insured is carrying the sufficient amount of insurance (Note: Personal property losses are only covered on a ACV basis. The DP-1 is designed for older dwellings not considered eligible for replacement cost coverage)
General Exclusions In the Dwelling Program:
1. Earth movements unless fire ensues 2. Water Damage – flood and the backup of sewers or drains 3. Neglect of property after a loss 4. Intentional loss on the part of the insured 5. War 6. Nuclear
Property not covered in the Dwelling Program:
1. Accounts, bill, deeds, evidences of debt, money, securities, bullion and manuscripts 2. Animals birds and fish 3. Aircraft and motor vehicles 4. Boats other than row boats and canoes which can be covered on premises
Deductible Clause
the standard deductible is $250
Cancellations in the Dwelling Program:
The company may cancel as follows 1. For non payment of premium - 15 days notice 2. Any other reason – 30 days advance notice
