Open Container Of Alcohol: A Case Study

INTRODUCTION:
This case involves the arrest of Jaime Zacarias for an open container of alcohol in violation of PMC 9.24.030- Possession of an Open Container of Alcohol in public. The suspect was found to have crystal methamphetamine in his possesion in violation of H&S 11377(a)-Possession of Methamphetamine. The suspect was arrested and later cited out.

INVESTIGATION:
On 12-23-15 at 0949 hours, I was working uniformed patrol with Officer Cass #2067. We were traveling west on Orange Grove Bl. approaching Marengo Avenue. Sergeant Villalovos was traveling east on Orange Grove Bl. and advised us, via our unit's radio that he observed a male Hispanic possibly in possession of an open container located at 230 E. Zacarias admitted the beer can belong to him and that he had been drinking out of it. I picked up the beer can which was half full and cool to the touch. I took a digital photograph of the beer can (see attached photograph.)
Zacarias did not have identification in his possession. I arrested Zacarias for PMC 9.24.040-Possession of an Open Container of Alcohol in public. Incident to arrest, I searched Zacarias and found a plastic baggie and a folded one dollar bill in his front right pants coin pocket. The plastic baggie and folded one dollar bill contained crystal methamphetamine.
Based on the above information, Zacarias was arrested for PMC 9.24.040-Possession of an Open Container of Alcohol in public and H&S 11377(a)-Possession of Methamphetamine. Sgt. Villalovos approved the arrest. Officer Cass and I transported Zacarias to the Pasadena Jail for booking. Zacarias was later released on a citation for PMC 9.24.040-Possession of an Open Container of Alcohol in public and H&S 11377(a)-Possession of Methamphetamine and is scheduled to appear at the Pasadena Court on 03-23-16 at 0830 hours (Citation #
