Let’s say that you have a cold and go to the doctor to get a shot. You go, spend about 15 minutes, and leave. The form that is filed with your insurance company says that you had surgery, took a blood test, had a complete examine, and on and on. The insurance company was paying for procedures that were never performed for more money. The doctor was receiving fraudulently obtained funds. Which as an outcome creates a lawsuit for fraud by the doctor.
This is one of the purposes of HIPAA to protect insurance companies. In turn, the public is protected. As the insurance companies are billed for lots of money, they raise their rates, which hits the public. When my parents first began working, they could go to the doctor and never pay a dime. Those who do not abide by the guidelines face a hefty penalty. Those who must abide by it include: health plans, health care clearinghouses, health care providers, directors, employees or officers. Some may not be directly liable, but they can still be charged with conspiracy or aiding to the violation. As a medical professional it is crucial to beware of who the information is being released to and if it follows the guidelines for HIPAA. Violations could consist of giving information out to a family member who is not on the release form. If a violation occurred it should be immediately reported to a manager. As for those who request medical information, giving out too much information could lead to a violation. When releasing information only the required information should be released. In all, HIPAA violations should immediately be reported and those violating could be facing criminal
