The Grievant James Evans had worked for the Kent County Sheriff Department in Grand Rapids Michigan as deputy on road patrol for ten years. The grievant wife Angelica Evans was a friend of a man named Miguel one of her co-workers. Another woman named Gloria Hernandez also with Miguel. Gloria was jealous of Angelica and Miguel’s friendship. Gloria got mad and broke Angelica car window out and was being verbally abusive towards her. Mrs. Evans went to the Police Department in Grand Rapids Michigan and filed a complaint on Mrs. Hernandez. The Police Department looked into the complaint that Angelica had filed. Then Mrs. Evans had called her husband what had happened and she told him she was afraid of Gloria, and he needed to do something about it.
The Grievant used his mobile data terminal in his patrol car to look Gloria Hernandez address. Then around 11:30 P.M he went to Gloria resident and waited for her to come out to her vehicle, then he pulled up behind her car while she was in the garage in her car. then the grievant got out his police car and order her to get out her car. once she got out her car officer Evans grabbed her hands and put them behind her back and slid her feet apart. Evans told her she need to pay for the damage of the window she broke in his wife Mrs. Evans car. then the grievant told her she didn’t get the window fixed that bad things would happen to her, and she would be deported back to Mexico. The sheriff department didn’t authorize for officer James to contact Gloria Hernandez. The grievant didn’t report on his log that he went to Gloria Hernandez apartment. The sheriff found out about this incident because Mrs. Hernandez filed a complaint on officer Evans. This is when the Sheriff department began an internal investigation on the complaint against James Evans. Once officer Evans was questioned about this complaint, then he had admitted to the encounter with Hernandez. Then after the investigation the chief of the sheriff’s department interviewed officer Evans and he admitted to these allegations, and didn’t think he did anything wrong by going to confront Mrs. Hernandez. ISSUES: According to the Sheriff’s Department, James Evans conduct had violated a lot of the departments rules and regulations. The first rule he violated was using the Lien and computer system personal use while being at work. James Evans abused his authority, unprofessional misconduct, reputation and integrity as a police officers while working for the Sheriff’s Department. Officer Evans used physical unauthorized force, threatening conduct, intimidation and didn’t document this while on duty. The Sherriff’s Department considers Mr. Evans unethical behavior to be very serious, and they considered his disciplinary record since he has been employed with the Sheriff’s Department. Mr. Evans had a few disciplinary actions he was suspended for four times. Mr. Evans discipline record he failed to show up for court appearance the magistrate was forced to throw out the case and the grievant was suspended for eight hours. On January 30,2002 received a reprimand to correct his work performance. The grievant had missed two court appearance, training classes and his overtime assignment. Lt. Parolini had read the grievant his garrity rights at the first interview and went through the allegations. The second interview the same questions were asked. The grievant claims that he didn’t receive a second notice for the interview, the Chief Deputy’s job is to send emails out to the union representative. The union representative did admit to receiving the email, but chose not to let the grievant know. The Sheriff Department ask for the grievance to be thrown out. The grievant had violated the policy and procedure rules, he had engaged in unethical behavior with citizens while on duty. The grievant also, used the computer system in the police car to find Mrs. Hernandez address. Mr. Adams abused his power while on duty and put the Sheriff’s Department reputation in jeopardy.
