Seals’ loaned the vehicle to Gammage who was visiting Syracuse, New York. As Gammage was driving he repeatedly braked to slow down the vehicle to remain with the speed limit. He was then pulled over by Officer Mullholland, Mullholland then called for back up and asked for Officer John Vojtas to be on the scene. While Mullholland ran computer checks on Gammage’s driver’s license another police officer arrived, Sergeant Keith Henderson. Henderson witnessed Gammage using his cellular phone in the vehicle and Sergeant Henderson then flashed his flashlight towards Gammage and drew his weapon. Both Vojtas and Henderson had their weapons drawn making Gammage step out of the vehicle with his cellular phone and datebook. Sergeant Henderson and Officer Vojtas threw the items in Gammage’s hands down and flashed their flashlight, Gammage then slapped the flashlight out of Vojtas hand. The law enforcement officials then tackled Gammage strangling him to death.
