In this assessment I will be using findings about the role of the Custody Officer to explore whether or not the Custody Officer adequately safeguards the rights of the suspects at the police station. Custody Officer is a designated police officer who must exercise the duties and the powers of a custody officer. They are the “gatekeeper” for the detainees, they are to look after and provide support for the detainees. The Police and Criminal Evidence Act (PACE) gives out the guidelines and it imposes the rules on how the procedure should be followed after the arrested person is brought to the police station. These safeguards are put in place to reduce the number of miscarriage of justice.
It is the custody officer’s responsibility to make sure that the detainee is informed of their rights while they are being detained, which follows Code C of Police and Evidence Act 1984, which includes the requirement to explain a person’s right while detained.
