Evidence of adverse impact on any protected class concentrated in lower-paying jobs
CapraTek hires semi-skilled production workers, who after one year are eligible to apply for training. Trained workers are then eligible to be promoted to the skilled production worker level. CapraTek needs to ensure that there is no adverse impact on protected class workers based on the company’s promotion practices. The company can do this by applying the 4/5ths rule (Arthur, 2012).
CapraTek is looking to hire workers in three phases to support its new manufacturing facility in Washington State. To prevent adverse impact on protected class workers, CapraTek needs to hire the following number of workers using the 4/5ths rule, based on the worker demographics
