The contract should not be enforced because there are parts of the U.S. that do not even acknowledge surrogacy contracts due to them being illegal. The mother should not have to give up the life of the child she births since she is the biological mother, she should however return the money that she was given for her services during the pregnancy. If she returned the money, then she should be able to keep her child without it being given to the parents in the contract in question as you should not be able to put a price tag on a life.
