In what three situations must an IMCA be involved in making decisions on behalf of a patient who lacks capacity?
If the decision involves:
1. Serious medical treatment provided by the NHS
2. A hospital stay of over 28 days, or a residential home stay of over 8 weeks
3. A long term move (>8 weeks) to a new hospital or care home
What are the five principles of the mental capacity act?
1. Capacity should always be assumed until an assessment is undertaken
2. People should be supported as far as possible in making decisions
3. People have a right to make eccentric choices
4. If a decision is made on behalf of a patient, it should be deemed to be in their best interests
5. If a decision is made on behalf of a patient, it should be the least restrictive option
