The case facts are as follows:
1. The store’s general manager (GM) relocated out of state and Maria applied for the open position.
2. Maria feels that she has a unique skill set and 5-years of experience with the Company.
3. Maria is bilingual and an asset to the company considering the bilingual customers
4. Interview went well, however, company promoted another employee with less experience and are not bilingual.
5. Maria questions the Regional Manager (RM) about his hiring rationale. The RM’s response, the other employee was a better fit.

The company consists of 26 stores in the chain and not one Mexican-American is in a management capacity.
2. The employee promoted to the GM position has consistently complained about her speaking Spanish with coworkers on the sales floor.
Human Resources main responsibilities are two-fold, (1) to protect the company’s interest and (2) to ensure compliance with labor and employment laws. Therefore, the HR Representatives job is to investigate Maria’s claims to ensure compliance with the Company’s promotional guidelines and to ensure that company did not violate any workplace discrimination laws. There were two questions as part of this week’s assignment and the next four paragraphs will answer these questions in their entirety.
