Stream Of Commerce Doctrine Definition

Decent Essays
The stream of commerce doctrine relates to the principle that a person who places a flawed or faulty product in the marketplace for consumers to buy is liable for any harm that the product may cause. The doctrine also allows a state to use personal jurisdiction over the defendant if they are found guilty of putting a bad product out in the marketplace. I believe that John Kendall in the book, Anne Orthwood’s Bastard: Sex and Law in Early Virginia, by John Ruston Pagan, is who the book is really about. I think the book is about John, because he was the only partner left of the extramarital sex issue after Anne Orthwood Passes away. Due to this mishap, a spiral of hardships and complicated court situations unravel for years and years to come. Once the court arrived to the supreme court, Gibbons’s attorney claimed that federal laws suppress the state laws with congress being allowed to control interstate trade. Although Gibbons had won the case, Ogden created the argument that Congress could only regulate trade at the borders where two states meet not within the whole state. Ogden lost the case because John Marshall had said that the commerce clause applied not only to interstate trade at borders, but within in all conflicts within the…

The Martin v. Hunter’s Lessee case is a Supreme Court case from 1816 that challenged appellate jurisdiction over state court decisions, specifically, the ability of the Supreme Court to hear and decide state cases where state court’s decided cases based on federal law. A British loyalist, Lord Fairfax, owned land in Virginia during the Revolutionary War when Virginia seized the land and gave a tract of it to David Hunter. Following the war, the United States entered into a treaty with Great Britain guaranteeing protection of lands owned by British loyalists. Once Lord Fairfax died and his land ownership passed to his heir, Thomas Martin, he sought to recover the land and sued. The Virginia court ruled that Fairfax and Martin were the owners of the land but upon appeal to the state appellate court, it was reversed in favor of Hunter.…

In early American history, not many Supreme Court cases had a larger impact than the impact felt after the ruling in McCulloch v. Maryland 17 US 316 (1819). The impact of this case is still felt today and a reverse judgement would have changed the landscape of this country’s financial system. McCulloch v. Maryland was argued in late February and early March of 1819, and decided on March 6, 1819, three days after the final arguments (Oyez). Although this case is not taught as often as Marbury v. Madison, it is still one of the more important judgements in early United States history and helped expand the power of the federal government through the supremacy clause and the commerce clause.…
