Fairness In Congress

For residents living in Washington D.C it is a question of fairness. Residents serve in the military, sit on juries, and pay federal taxes just like everyone else. But because of the capital’s status as a federal congress, they do not have voting representation in congress, they have no say in the nation’s laws. They also have limited control over their own affairs. D.C’s second-class status goes back to America’s earliest days. The founding fathers thought it would be best if they kept the nation’s capital a federal district, and they included that in the constitution. They thought that if the capital were in a state then the state would have control/influence over the federal government. As time passed the residents wanted to have a say in

The justice approach stems from the Aristotelian philosophy where it is stated that “equals should be treated equally and unequals unequally”. The justice model of ethical decision-making can be described as “moral obligation to act on the basis of fair adjudication between competing claims. Hence, when making the decision, the individual should assess how fair the action will be and if it could potentially discriminate and show favouritism. Discrimination by definition “imposes burden on people who are no different from those on whom burden are not imposed”. Favouritism, on the other hand, provides benefits to a certain group of people, without a justifiable reason.…

In the 2000 presidential election between George Bush and Al Gore, Gore won the popular vote but lost the electoral college; this had only happened four times in history. This brought out a lot of controversy between people who didn’t understand how the electoral college worked. The electoral college is made up of representatives of each state, who vote for the president and vice president. Each representative is voted for by their individual state voters, whom they will represent. Currently, there are 538 total electors, 271 votes needed to win the electoral college.…

Does it make sense for people to follow laws that were established more than a hundred years ago? The Texas Constitution of 1876, which is currently in use (Maxwell et al. 60), states in Article 4, section 23 that “the comptroller of public accounts, commissioner of the General Land Office, attorney general, and any statutory state officer who is elected statewide to reside at the state capital during their terms of office” (). The powers of the President are listed in Article two, Section two of the Constitution and unlike the powers granted to Congress, the list of Presidential powers are short and vague. Before the original thirteen states declared independence from Britain, they were colonies ruled over by King George III. Although the colonists were taxed, they had no one to represent their needs in British parliament. This taxation without representation was a key factor in provoking the American Revolution, in which the newly formed union declared independence from Britain and the tyranny of the king. In order to prevent one person from having most of the power the framers of the Constitution gave legislative powers to Congress because the members were elected by the people but the framers recognized a need for quick, decisive action that Congress could not provide. “The historian Jack N. Rakove has…

Can an argument be made that alternative dispute resolution diminishes our constitutional rights to a fair trial? Compare and contrast the fairness between a civil trial court decision and a decision reached by a single mediator in a binding mediation. The fairness of a civil trial decision and a mediation decision has many differences, such as who makes the decision and whether or not there is a right of appeal. The fairness of a civil trial decision includes a judge, jury, a winner and a loser.…

When the founding fathers first established the U.S. Congress, congress was considered an unpopular job. Congress members had to travel far, be in sessions that were long and hot and there was not much to do in national government. Nonetheless, Congress has become a strong and stable institution through careerism and organization of committees. However, party leadership power is dependent on how much the constituent knows and feels about government and if there is a divided government Congress has many layers to make it an institution, which establish the way congress operates. One of the reasons is because being a congress member is now considered a highly favored and highly praised career.…

The practice of imprisoning civilians for unpaid fines is creating an unfair division in today’s justice system (Hoag 747). The system appears to be separately constructed for the poor and wealthy rather than equally established to ensure a fair hearing for all individuals (Hoag 747). Hoag indicates that despite their economic circumstances, poor civilians are expected to pay additional fees for housing and equipment while awaiting their trial in jail (747). Many civilians are granted the opportunity of leaving their prison cells if they can afford to post bail (Hoag 752). Hoag notes that “while both are presumed innocent, wealthier people can buy their freedom pending trial, whereas poor people cannot” (749).…

Alice, Great question, I think that to create a system that would prove to be both equitably fair and cost effective at the same time it is essential that it be regulated at the state level. The system needs to be able to compensate those individuals who have suffered damages in a matter specific to their current financial situation, as well as the current economic situation of their area, which I feel could only be accomplished at the state level. I do however, feel that states should have an open line of communication with one another as our country does with the United Nations, rather than have the federal government come in and make decisions for the states as a parent would with two children who can’t seem to get along.…

Additionally, ethics will continue to play a role in implementing policy to guide the health care industry to serve all men fairly with respect and dignity and to teach the staff how to behave ethically.
