The complications involved in trying to determine impaired sex and rape are that both the terms depend on the act that was committed. Rape in my own understanding is when person A wants to treat person B’s life recklessly and without consent in order to achieve sexual pleasure. Person A would need to have any type of sexual intercourse as their prime motive, and they have no intention in asking person B for consent, knowing that they will refuse. Some of those difficulties are events in which a female, for example, becomes so intoxicated that she forgets about the consent she gave the night that the sexual intercourse occurred. Punishing a man for having sex with someone who was able to give consent but later forgets about it, would overall be unfair. I argue in defense of the people who are punished for being involved sexually with a person who irresponsibly drinks too much and allows someone to have sex with him or her.
