Is the patient responsible for himself or does he have a power of attorney? Has the surgery occurred? The case states “for prostatic surgery” not “recovering from prostatic surgery”. Has the patient been agitated and hostile previously and/or recently? Does the doctor have the right to restrain the patient and administer medication to sedate him? Is this common practice? This case is calling for an ethical case for a false imprisonment and aggravated assault lawsuit. Beliefs: I believe that no harm was done to the patient. I believe the hospital was acting within reason and doing what is right to ensure no future harm to the patient or anyone else. I do not believe the hospital should have allowed the patient to leave or be discharged unaccompanied. Consequences: Due to the nature of the situation, I do not believe that the physician had time to access the situation and react differently. The patient’s violent behavior led the physician to restrain and sedate him. If the physician did not restrain and sedate him, he could have caused more harm or even harmed himself. Also, due to Medicare’s readmission law, the patient might not have been able to come to the hospital for the surgery since the hospital would have had to discharge him. And I do not believe that this would have been in the best interest of the patient. Decision: I would go to court and plead my case.
