The term “Separation of powers” was created by Charles-Louis de Montesquieu, a French political philosopher of the 18th century. His doctrine of the separation of powers was based in the idea that the political authority of the country has to be divided in three branches which are the legislative, executive and the judicial branch. His idea was that these three branches must work separated form each other in order to avoid the abuse of power. Personal separation of powers means that no single person is part of the legislative, executive or judicial branch at the same time, because it would be difficult for that person to separate different functions and to be objective in the constitutional functions. Institutional means that institution of the state are not awarded to separate powers at the same time and functional refer to the question whether a prime minister may held a seat on the parliament it look at the functions on the constitutional order.
Separation of powers intend to achieve a kind of balance between the three branches so no one has more power than the other and this is intended to protect against the tyranny and as a main subject preserve liberty . With this idea you could have a proper democracy cause the power is not going to be in one body what can lead to dictation, but divided in three separated bodies. In electoral mandate we have three different kinds of mandates which are the parliamentary system, the presidential system and the mix system. In the presidential system the president is both the head of state an the head of government, the president is chosen by the people. This system provides the people with more choices, people have the right to choose their head of government and legislative representative. This system is thus a parallel system, the executive and the legislature stand next to each other and the people are the ones that give mandate to these branches . The second mandate is the parliamentary system this system has a head of state and head of government, the main point of this system is the fusion of powers. What is meant with this is that the executive branch is hierarchal subordinated to the legislative branch so the executive branch is controlled by the legislative branch. In this system the people give the mandate to the legislative branch and the parliament are the ones that gives mandate to the executive branch so we can see a clear hierarchy in this system. The last system is the mix system, this ones has a head of state and a head of government too.
As the name itself says its a mix between the executive and the legislative branch with a hierarchical one. The
